Studio Rules

Effective 1st August 2019
The acceptance of an application for membership of Fitness Theory shall constitute a legally binding agreement between the member and the club. The member hereby agrees also to be bound by the Studio Rules, a copy of which can be provided by asking at Reception.

1. Membership Types and Eligibility
Core – Initial 45 minute personal training session, must be taken in first 4 weeks of membership, cancellations must be with 24 hours notice otherwise the session will be forfeited.

Core + Weekly Personal Training – entitles the member to weekly 45 minute personal training session, must be booked in advance. Cancellations must be with 24 hours’ notice otherwise the session will be forfeited.
Please note sessions in this membership type must be used in the week (Mon – Sun) and cannot be rolled over.

Core + Hot Classes –Core membership plus unlimited hot classes, subject to availability of spaces in classes. The studio does not guarantee a minimum number of hot classes per week but will endeavour to maintain at least 3 a week on the timetable.

While the club will endeavour to ensure member has the same coach for all sessions, in unavoidable circumstances the club may be required to assign other coaches to cover personal training sessions.

Members are free to upgrade their membership type at any time they choose, upon
confirmation of their decision to upgrade and organisation of payment to Fitness Theory, their upgraded membership pathway will begin in line with the terms of the membership from that date as if it was the date they joined the studio. Upgrade enquiries can be made to the General Manager or Coaches within the studio, confirmation of upgrade should be
sent to hello@fitnesstheory.co.uk.

2. Transferring or downgrading membership types
Memberships are non-transferable to other individuals. Memberships can be downgraded after the fixed contract term, all membership downgrades are based on pricing at the effective date of downgrade, prior offers or pricing cannot be applied.

3. The membership renewal
Upfront memberships are subject to renewal, however, all other memberships on expiry of initial contractual term will automatically move to a rolling 30-day contract.

4. Membership cancellation process
As per the T&Cs of the contract, cancellations within a fixed contractual term are only permitted in the following circumstances:
– Illness or Injury: Letter from GP or referring Doctor required (must be a valid medical
reason) – 30-day notice
– Re-Location: Proof of relocation out of the area is required – 30-day notice
– Bankruptcy: proof required – no notice period

Written correspondence must be addressed to fitnesstheory@clubright.co.uk, and effective from date of acceptance/acknowledgement from the Studio GM or equivalent.

If the minimum fixed contract term has surpassed, then one further full payment will be taken from the date of this correspondence, as a 30-day notice period.

Annual upfront membership will run until the anniversary date. This membership is nonrefundable and will not renew without payment.

Upfront memberships and payments are non-refundable.

Wrist bands must be returned to Fitness Theory.

5. Membership Freeze
Members can freeze their membership for a minimum for 3 months, with a notice of 30 days. A monthly freeze fee will apply.

All freeze requests must be sent to fitnesstheory@clubright.co.uk.

6. Additional Upgrades and Packs
Additional products and services are sold within the club, see below conditions:
– Personal Training Packs – must be paid upfront and are non-refundable
– All wellness packages are paid upfront (unless stated otherwise) and are nonrefundable
– 10 pack of Personal Training is valid for 12 weeks
5 pack of Personal Training is valid for 7 weeks
– 3 pack of Personal Training is valid for 5 weeks

7. Behaviour
If any member shall cause a nuisance or annoyance to other members, guests or staff, ormisuse the club facilities, or generally behave inappropriately, the club reserves the right to refuse admission or suspend or terminate membership. Abusive language, threatening or violent behaviour will not be tolerated.
Members must be over the age of 16 years. All minors must be accompanied by an adult at all times. Permission must be sought for any camera usage.

8. Booking
Classes (or gym floor) may be booked up to 1 weeks in advance via the App/ Member
booking system. Members are responsible for cancelling their class if they can no longer attend, failure to do so may result in a temporary ban on booking future classes. Classes do have a waiting list option, you will be notified by email if a place becomes available, if you have been successful in gaining a reserved place you will be notified by email. Members are also responsible for cancelling any sessions with their Coach with 24 hours notice.

9. Personal Training
Members are responsible for booking their own personal training sessions with their Coach, should you need to cancel your session, you should do so with at least 24 hours’ notice. Less than 24 hours may result in you forfeiting the session and incurring a charge. All personal training must be paid for before the session takes place and is non-refundable.

10. Changing rooms
Any minor under the age of 16 must be accompanied by their parent/guardian when
entering the changing room. They must not use the changing room of the opposite sex if over the age of 8 years old. Changing rooms are checked regularly for cleanliness by a member of staff.

11. Classes
All class attendees should arrive to the studio at least 5 minutes before their class is due to commence. Any attempted late entries may be rejected or their class space reallocated by the instructor.

Please respect other class attendees when entering and using the studio. Class attendees must also be respectful to any equipment used during the session and should use the cleaning products available at the end of the session.

12. Comments and Complaints
Please refer any comments or complaints to a member of staff, any written complaints must be addressed to the General Manager.

13. Fitness Areas
Club approved footwear and clothing must be worn at all times.

Access to fitness areas may be limited in the event of classes or pre-organised sessions.

14. Guest lockers
For security reasons, members and guests are asked to store personal belongings in the lockers provided. Lockers are provided on a daily basis only, any items left overnight will be removed and treated as lost property. Belongings are left at owner’s risk.

15. Lost Property
All lost property found on the premises should be handed in to reception. Items whose ownership cannot be identified will be donated to charity.

16. Opening Hours
The club’s opening hours, are displayed within the facility. Members must ensure they are ready to leave the facility at the stated closing time, they should leave adequate time if showering and dressing is required. A member of staff will open the club at the time stated within the opening hours.

Guests must book in with a member in advance and they should be accompanied by the member at all times and must pay on entry (if applicable). Members should not leave the premises before their guest. All guests must complete and sign an HCS

17. Safety and hygiene
Before using the facilities. The club reserves the right to refuse admission to a guest for reasons for health and safety or if the guest has previously not complied with club rules.

18. Health Commitment Statement (HCS)
Upon joining the club all new members are required to complete and sign a HCS. The purpose of this is to ensure that the club’s staff are fully informed of any physical or medical condition which could affect the member’s ability or suitability to take part in physical activities.

Only if the club’s staff are fully informed, can they assess the member’s health and fitness level and prepare an appropriate exercise program. The club strongly recommends that all members seek medical advice before commencing a new exercise program and the club reserves the right to request a doctor’s certificate and to reject a membership application if a satisfactory doctor’s certificate is not received by the club.

In the interest of safety and hygiene, no crockery or glass should be brought on to the
premises. No food or alcoholic drinks should be consumed on the premises. No pets will be allowed to enter the club, with the exception of guide dogs. Cleaning products are available within the club, these should be used by the members and guests as necessary during their sessions. Fire exits, which are clearly marked, are there in the interests of safety, they must not be interfered with for any reason. In the event of an emergency evacuation, members and guests must immediately make their own way to the nearest available exit.

19. Terms & conditions of membership agreement
All members agree to abide by the terms & conditions of their membership which are
available from the General Manager; when joining the club, the member approves the terms & conditions online and/or via a signed paper form.
